We want to emphasize that regardless of the changes in the legal landscape, Pediatrics of Sugar Land has always prioritized parental choices regarding their child’s healthcare.

What is this new law all about?

Coming into effect on September 1, a newly enacted state law (House Bill 44) prohibits healthcare providers from withholding services to patients enlisted in Medicaid or the Children’s Health Insurance Program (CHIP) based on their vaccination status.

What does the evolution of HB 44 mean?

Initially, HB 44 aimed to exclude physicians from Medicaid and CHIP if they chose not to attend to unvaccinated patients. However, after careful deliberation during the 2023 legislative session, the bill has been revised. The final version which was passed allows healthcare practitioners to establish a vaccination policy but requires them to acknowledge conscientious, religious, or medical exemptions typically recognized in schools.

How does this influence healthcare and wellness?

Though the law is set to take effect from September 1, complete rules relevant to its implementation might only be concluded by late 2024, according to the Texas Health and Human Services Commission. Healthcare providers found in violation risk delayed Medicaid and CHIP payments until they adhere to the law. Specialists in the fields of Oncology and organ transplant services are not subject to this legislation.
